Before you quit

Quit or wait: what a Sperrzeit costs you.

Checked against arbeitsagentur.de · October 2026

If you resign, or sign an Aufhebungsvertrag, the Arbeitsagentur usually blocks your unemployment benefit for twelve weeks and cuts your total entitlement by at least a quarter. Wanting to start a business is not a reason that avoids the block. For founders the second effect is the bigger one: the shorter entitlement can push you below the 150 days the Gründungszuschuss needs. So before you quit, read what the alternatives are.

What the Sperrzeit is.

A Sperrzeita block: weeks in which no benefit is paid is the Arbeitsagentur’s answer to a job loss you caused yourself. The law behind it is § 159 SGB III. If you end the job without an important reason, the block is twelve weeks. During those weeks you receive no Arbeitslosengeldunemployment benefit, and under § 148 SGB III your total entitlement shrinks by at least a quarter of its original length.

Two things count as ending the job yourself: handing in your resignation, and signing an Aufhebungsvertraga mutual termination agreement. The agency’s guidance treats both the same way unless an important reason applies, and it lists what counts. Wanting to become self-employed is not on that list.

What it costs, in numbers.

12 weeks of no benefit after a resignation or an Aufhebungsvertrag, usually
¼ less of your total entitlement, at least; with 12 months granted, that is 3 months gone
150 days of benefit you still need on the day you apply for the grant

Illustrative. The Arbeitsagentur decides on the Sperrzeit case by case; your Bescheid states your entitlement.

Take a founder with twelve months of benefit. After the block and the cut, roughly nine months remain, and the first three of them pay nothing. The 150-day line for the grant then falls about four months after the job ends, instead of about seven. The time to validate an idea, write the plan and get the viability statement shrinks to a few weeks.

Take a founder with six months of benefit. After the cut, about four and a half months remain, and the 150-day line is behind them before the block ends. The grant is out of reach.

Why the voucher is affected too.

The AVGS for founder coaching is meant for people who are unemployed or whose job is ending. The agency’s guidance names those two groups, and it names who does not fit: people in a permanent job who want a change for personal reasons. Quitting does make you unemployed, but it also starts the block, and during a block the agency has little reason to fund coaching for a start that may no longer qualify for the grant.

The alternatives, in order.

  1. Wait for the employer to end it. A termination by the employer, or a contract that runs out, carries no block. If restructuring is in the air, let the notice come to you.

  2. If an Aufhebungsvertrag is on the table, read it with a lawyer first. Whether the agency sees an important reason depends on the wording and the circumstances, for example a termination that would have come anyway. That is a legal question; this guide cannot answer it.

  3. Reduce hours instead of quitting. Some founders prepare the business while still employed and use the Arbeitsagentur route only once the job ends on its own. The coaching has to wait for that, but the plan does not.

  4. If you do quit, plan around the block. Register as job-seeking on time, count your remaining days from the Bescheid, and start validating before day one. The founder route is still open; the window is smaller.

What to do today.

Nothing irreversible. Enter your dates on the How it works page to see your registration deadlines, and run the Eligibility Check: if you are employed with no notice, it tells you so and sends you here. If you want to talk it through before you decide, that is what the Fit Call is for. I say so if quitting would cost you the grant.

General information, not legal advice. Whether a block applies in your case is the agency’s decision, and whether an agreement avoids it is a question for an employment lawyer.
